Terms of Service

1. Accepting these terms

These Terms of Service (the “Terms”) are a legal agreement between you and Livedrp™ LLC (“Livedrp”, “we”, “us”), a Florida limited liability company. They govern your use of the Livedrp mobile app and the livedrp.app website (together, the “Service”).

By creating an account, or by using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Who can use Livedrp

You must be 18 years or older to create a Livedrp account. Livedrp surfaces bars, nightlife venues, and events that may serve alcohol or be restricted to adults.

Livedrp does not sell alcohol and is not responsible for admission or age policies at any venue. Entry requirements are set by each venue.

3. Your account

• Give accurate information when you sign up, and keep it current.
• You are responsible for activity under your account and for keeping your login secure.
• Don't share your account, impersonate anyone, or create an account for someone else without their permission.
• You can delete your account at any time from the Profile screen in the app, or by contacting us. See Delete your account.

4. Content you post — and our zero-tolerance policy

Livedrp lets you post to a venue's Wall: short messages, vibe tags, photos, and videos from the night, plus event listings if you are a venue or an artist (“User Content”).

We have zero tolerance for objectionable content and abusive users. You may not post User Content that is:

• Harassing, bullying, threatening, or that targets a person;
• Hateful or discriminatory toward any person or group, including on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or age;
• Sexually explicit, pornographic, or sexually suggestive involving minors in any way;
• Violent, gory, or that promotes or threatens violence or self-harm;
• Illegal, or that promotes illegal activity, including illegal drug sales;
• Someone else's private information, or a photo or video of a person taken without their knowledge in a private setting;
• Spam, advertising, scams, or repetitive promotional posting;
• Impersonating another person, venue, or artist;
• Infringing on someone else's copyright, trademark, or other rights.

You keep ownership of your User Content. By posting it, you grant Livedrp a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the Service for the purpose of operating and promoting Livedrp. This license ends when you delete the content or your account, except for copies retained in backups or where we must keep records to comply with law.

You are responsible for your User Content and confirm you have the right to post it.

5. Reporting, blocking, and moderation

Every Livedrp user can:

• Report any Wall post from the post's own menu in the app;
• Block any person, which hides their posts from you and prevents further contact.

Photos and videos posted to Livedrp are screened automatically before they appear, and text is screened for abusive language. Automated screening is not perfect, so human review backs it up.

We review reports of objectionable content within 24 hours and will remove content and eject the user who posted it where these Terms have been broken. Venue owners may also remove posts and ban individuals from their own venue's Wall.

You can also email dawn@livedrp.app to report anything, including content you cannot reach in the app.

6. Venue and artist accounts

If you sign up as a venue owner or an artist, you additionally agree that:

• You are authorized to represent that venue or act, and the information you post about it is accurate;
• Event details you publish (dates, times, cover, line-up) are your responsibility to keep correct;
• You will not post events at a venue you have no relationship with, or claim a venue you do not represent;
• Livedrp may verify a claim, and may reverse it if the claim turns out to be false.

Artists may post their own shows at any venue. A venue may correct or cancel listings that appear on its own page; where a venue changes an artist's listing, the artist is notified of what changed.

7. Subscriptions and payments

Livedrp is free to use. We also offer optional paid subscriptions — a fan subscription and a venue subscription — which unlock additional features.

• Billing. Subscriptions purchased inside the iOS app are billed through your Apple ID; subscriptions purchased on the web or by invoice are billed by us through our payment processor.
• Auto-renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the current period ends.
• Cancelling. Cancel an App Store subscription any time in your Apple ID subscription settings; cancel a web or invoiced subscription by contacting us. Cancelling stops the next renewal — you keep access until the current period ends.
• Free trials. If a trial is offered, it converts to a paid subscription at the end of the trial unless cancelled before it ends.
• Refunds. Purchases made through the App Store are refunded by Apple under Apple's policies. For web or invoiced payments, contact us.
• Price changes. We will tell you before a price change takes effect, and you can cancel if you don't want to continue.

Artists are never charged to use Livedrp.

8. Event information is not guaranteed

Livedrp gathers event and venue information from venues, artists, and public sources. Details change constantly — shows get moved, cancelled, sold out, or listed wrongly at the source.

Always confirm with the venue before you travel. Livedrp does not guarantee that any event will happen as listed, that a venue is open, or that information shown is accurate or current, and we are not liable for a wasted trip, a missed show, or a cover charge.

9. Things you may not do

• Break the law, or use Livedrp to harm, harass, or defraud anyone;
• Scrape, crawl, or bulk-extract data from the Service, or resell our data;
• Reverse-engineer, decompile, or interfere with the Service or its security;
• Use bots or automation to create accounts, posts, or votes;
• Falsify your location to post to a venue's Wall you are not at;
• Overload or disrupt our systems.

10. Suspension and termination

We may suspend or terminate your account if you break these Terms, and we may remove any content that breaks them. Serious violations — including harassment, hateful content, sexual content involving minors, or threats — result in immediate removal and a permanent ban.

You may stop using Livedrp and delete your account at any time.

11. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information on it is accurate. Livedrp does not operate, endorse, or control any venue, artist, or event listed.

12. Limitation of liability

To the fullest extent permitted by law, Livedrp™ LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) one hundred US dollars ($100).

You agree to indemnify and hold Livedrp harmless from claims arising out of your User Content, your use of the Service, or your breach of these Terms.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. App Store terms

If you downloaded the Livedrp app from the Apple App Store, you acknowledge that:

• These Terms are between you and Livedrp™ LLC only, not with Apple, and Livedrp alone is responsible for the app and its content;
• Apple has no obligation to provide any maintenance or support for the app;
• If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation;
• Apple is not responsible for addressing any claim relating to the app, including product liability, legal or regulatory non-compliance, or consumer protection claims;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Changes to these terms

We may update these Terms as Livedrp grows. When we make a material change we will update the date at the top of this page and, where the change matters to you, notify you in the app. Continuing to use Livedrp after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Duval County, Florida, and you and Livedrp consent to that jurisdiction.
